Can I file for Custody before My Child is Born?

In Maryland, the law treats mothers and fathers equally, with no preference for gender when making determinations of child custody.

This is simply not the case when it comes to an unborn baby. An unborn baby can't obviously be anywhere other than the mother’s womb, so technically the mother has “custody” of the unborn child by default of biology until the child is actually born. Of course as a father, or someone who believes he may be the father, you also want to protect your parental and custodial rights prior to the birth of your baby.
