In both Maryland and the District of Columbia, father’s rights are usually enforced through the establishment of the paternity of the child(ren). If the child’s parents were married at the time the child was born, the husband is presumed to be the father. If, however, the child’s parents were not married when the child was born, paternity is established through a legal process; specifically, paternity is established by either an affidavit or court order. Both of these options ultimately provide the father with assurance that his parental rights are protected.
